Terms & Conditions

Please read these Terms and Conditions carefully before engaging Cairnstone's services. By scheduling a session or purchasing a programme, you confirm that you have read, understood, and agreed to be bound by these terms.

1. Definitions

"Agreement"
— these Terms and Conditions together with any booking confirmation or service order.
"Cairnstone" / "We" / "Us" / "Our"
— Cairnstone, operating at 26 Phuket Road, Muang, Phuket 83000, Thailand.
"Client" / "You" / "Your"
— the individual or family engaging Cairnstone for organisational or educational services.
"Services"
— the document organisation, information sessions, and archiving programmes described on our website.
"Session"
— a scheduled appointment or programme of work between Cairnstone and the Client.
"Materials"
— any documents, templates, written guides, or reference materials produced or provided by Cairnstone during a Service.
"Content"
— information, documents, and records provided to Cairnstone by the Client for organisational purposes.

2. Acceptance of Terms

By booking a Session or purchasing a programme through our website, by telephone, or by email, you enter into a binding Agreement with Cairnstone on these terms.

You represent that you are at least 18 years of age and have the legal capacity to enter into this Agreement. Where you are engaging on behalf of a family or estate matter, you confirm that you have the authority to do so on behalf of those you represent.

If you do not agree with any part of these terms, please do not proceed with a booking.

3. Service Description

Cairnstone provides educational, organisational, and archiving services to families in Phuket and the surrounding region of Thailand. Our current service offerings are:

  • Records Organisation & Labelling — assistance arranging and labelling a family's own documents into a clear archive structure. No legal or financial advice is given.
  • Estate Organisation Information Session — a plain-language educational session on how estate organisation and succession concepts generally work, and which official bodies or licensed professionals to approach for regulated steps. No individual estate is assessed.
  • Archive, Inventory & Wishes Programme — a multi-session programme supporting families in compiling, digitising, and recording personal wishes for safekeeping, with signposting to appropriate professional services.

Services are delivered in person at our Phuket office or, where agreed, at the Client's location within Phuket. Remote delivery may be offered at Cairnstone's discretion.

Important scope limitation: Cairnstone is not a law firm, financial advisory, valuation service, or notarial service. Nothing we provide constitutes legal advice, financial planning, asset valuation, representation, or guidance on entitlements. Clients requiring such services are directed to appropriately licensed professionals.

4. User Responsibilities

When engaging our services, you agree to:

  • Provide accurate and truthful information relevant to the service being delivered.
  • Ensure you have the right to share any documents or records you bring to a Session.
  • Attend booked Sessions at the agreed time or provide reasonable notice if cancellation is required.
  • Use educational Materials provided by Cairnstone for your own personal, family, or non-commercial reference only.
  • Not misrepresent the nature of Cairnstone's services to third parties.
  • Seek the advice of qualified legal, financial, or notarial professionals for any matters that require them.

You agree not to use our services for any unlawful purpose or in a manner that could harm Cairnstone or any third party.

5. Intellectual Property

All Materials, guides, templates, frameworks, and other content created or provided by Cairnstone during a Service remain the intellectual property of Cairnstone unless expressly agreed otherwise in writing.

We grant you a personal, non-exclusive, non-transferable licence to use Materials provided during your Service for your own family or personal reference. You may not reproduce, distribute, sell, or share our Materials with third parties.

Documents and records you bring to a Session remain your property at all times. We do not retain originals without your written consent and return or destroy copies on request.

6. Payment Terms

All prices are displayed in Thai Baht (฿) and are inclusive of applicable taxes unless stated otherwise. Current service fees are:

  • Records Organisation & Labelling: ฿3,600 per session
  • Estate Organisation Information Session: ฿4,600 per session
  • Archive, Inventory & Wishes Programme: ฿28,500 (full programme)

Payment is due prior to or at the time of the first Session unless a written payment schedule has been agreed. We accept cash (Thai Baht), bank transfer, and other methods confirmed at the time of booking.

Cancellation and refunds: Sessions cancelled with more than 48 hours' notice will receive a full refund or reschedule at no charge. Cancellations with fewer than 48 hours' notice may be subject to a cancellation fee of up to 50% of the session fee. For multi-session programmes, completed sessions are non-refundable; unused sessions will be refunded on a pro-rata basis if the programme is discontinued by the Client. Cairnstone reserves the right to reschedule sessions where necessary and will offer reasonable alternative dates.

7. Service Delivery Terms

Sessions are scheduled by mutual agreement and typically take place during Cairnstone's operating hours (Monday to Friday, 09:00–17:00, Phuket time). We will confirm the date, location, and duration of each Session in writing or by telephone.

The scope of each Service is as described in the service summary and on our website. Any change to scope requested by the Client will be discussed, and additional fees may apply.

Cairnstone exercises reasonable care in organising and handling documents. We are not responsible for pre-existing damage to documents or for decisions made by the Client based on the educational content of a Session.

All information shared during a Session is treated with discretion. We do not disclose Client information to third parties except where required by Thai law or with the Client's consent.

8. Disclaimers

Cairnstone's services are provided on an "as is" and "as available" basis for educational and organisational purposes only.

We make no representation that:

  • any organisational system we help create will meet specific legal or official requirements;
  • information shared in a Session is complete, current, or applicable to your specific circumstances;
  • engaging our services will lead to any particular outcome in any estate, succession, or administrative process.

Educational content is general in nature. For guidance on your particular situation, you should consult a qualified legal, financial, or official professional. Where relevant, we will direct you to appropriate bodies and licensed professionals.

9. Limitation of Liability

To the fullest extent permitted under Thai law, Cairnstone's total liability to you arising out of or in connection with a Service shall not exceed the amount you paid for that Service.

Cairnstone shall not be liable for:

  • indirect, consequential, or incidental losses;
  • decisions made by the Client or third parties based on information provided in a Session;
  • outcomes in any legal, financial, or administrative proceeding;
  • loss or damage to documents beyond our reasonable control;
  • circumstances arising from force majeure, including but not limited to natural events, government action, or public health measures.

Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

10. Indemnification

You agree to indemnify and hold harmless Cairnstone, its staff, and representatives from and against any claims, losses, or costs (including reasonable administrative costs) arising from your breach of these terms, your misuse of our Services, or your provision of inaccurate information during a Session.

11. Termination

Either party may bring the engagement to an end by providing written or verbal notice before scheduled Sessions. Cairnstone reserves the right to decline to continue a Service if the Client acts in a manner that is harmful, disrespectful, or outside the agreed scope.

Upon termination, the Client's licence to use any Materials provided up to that point remains in effect for personal use. Cairnstone will return or destroy any Client documents held, as agreed.

Sections concerning intellectual property, disclaimers, limitation of liability, and dispute resolution survive the end of any engagement.

12. Dispute Resolution

These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from or connected with these terms or our Services shall be subject to the jurisdiction of the courts of Phuket Province, Thailand.

Before seeking formal resolution, we encourage you to contact us directly. We will make a genuine effort to resolve concerns through informal discussion within a reasonable timeframe. Most matters can be resolved quickly and amicably by getting in touch with us at [email protected].

Where informal resolution is not possible, disputes may be referred to mediation before formal proceedings are commenced, if both parties agree.

13. General Provisions

Entire Agreement: These terms, together with any booking confirmation, constitute the entire agreement between us in respect of the Services and supersede prior communications.

Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.

Waiver: Failure to enforce any provision does not constitute a waiver of the right to do so in future.

Assignment: You may not assign your rights or obligations under this Agreement without our prior written consent. We may assign our obligations to a successor organisation, with reasonable notice to you.

Notices: Notices may be sent by email to the addresses provided at booking, or by post to the respective addresses. Email notices are deemed received the following business day.

14. Changes to These Terms

We may update these terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. For significant changes, we will make reasonable efforts to notify existing Clients by email or by posting a notice on our website.

Your continued use of our Services after changes become effective constitutes acceptance of the updated terms. If you do not agree with updated terms, please discontinue use of our Services and contact us to discuss any bookings in progress.
